FYI:  A homeowner/business owner in Tremont filed a lawsuit yesterday  against Tremont West Development, City of Cleveland, and others for searching, boarding, condemning and threatening to demolish his home. He went from zero violations to condemnation/demolition threat within a 30 day period.  He was never afforded an opportunity to defend himself in court.  The attached picture should prove to everyone that there were absolutely no conditions on the exterior of the home that would warrant a search warrant, condemnation and demolition threat.  The photo was taken right after the search warrant was excuted. Fortunately, he was able to hire an attorney and the case is pending in Federal Court.

 

There is also another business/homeowner in Tremont that is facing the exact sitution.  Zero violations to demo list within 30 days.  One of her beautiful properties is already pictured on "Tremont Capitalism". Please  call me at 216 386-6546 if you have any information regarding other homeowners with search warrants, condemnation or demolition issues, especially in the Tremont area.

Does anyone know what is happening with them? I looked at the case on line with Bell (failure to remove nuisance, no clue what that means) but did not see how that lead to a search then demo order. I hope that they have fared better than Frank Giglio.

What is that stone and wood wall to the left - it looks like a wall from a Gates Mills estate was moved next to this simple neighborhood-scale house... something here isn't right!!!

Tremont Tours by Frank Giglio

I spoke with Frank this morning at Lucky's.

He wants to give walking tours of Tremont to help people know the Tremont he knew not too long ago -- in exchange for donations to help him afford legal counsel.

He asked that I post this. I'll take his tour. Anyone else?

I accompanied Frank G to TWDC yesterday at his request. He wanted to speak to Ward 13 Code Enforcement Officer Katie Hough, (but that Frank only knew of as "Katie", "Kitty", or "Mary", as she had introduced herself as all three,) to ask her to stop coming on his property, and let her know she was violating his rights and distressing him, -- intentionally, he believes.

Frank recognized her car outside the TWDC office, but we were told she was out to lunch.

We were allowed to sit and wait for Katie's return, but Executive Director Chris Garland came out quickly from the back offices to speak with us.

Chris was calm and diplomatic, as was Frank, but he told Frank that if he was there to talk about his property on W. 14th, that TWDC had nothing to do with it and could not help him, and that he should talk to the housing and building authorities instead. He would not tell Frank Katie's last name or real name, who she was or what position she held, nor allow Frank to speak with her. Neither wanted to answer the others' questions, but when Frank finally gave Chris the message he had hoped to deliver to Katie personally, Chris said he would relay it to the best of his ability.

As we were leaving, not having been there 10 minutes, a police car pulled in to park behind Frank's car, and the two officers that had been called because there "might be some trouble," which there was none. Frank told me afterward that one was 2nd District Lieutenant Bolon, who had sprayed him in the face with mace years ago, and the other was the one that had intelligently told Frank that he would find a reason to take Frank back to jail (in front of Chuck Hoven.)

There were a few salty words said by both parties, and we left peaceably while the officers walked toward TWDC.

I think my time in the neighborhood is soon ending. This game has obviously been played long before I moved in 4 years ago, but I'm tired of it already, and it's gone too far for me.

That the life is being sucked out and replaced with the uninteresting, unreal, and unsustainable is sad. That it is done with so little respect for those who have built their lives there -- and are the fabric of the community -- is reprehensible. That it's being done unlawfully is only criminal.

The Ohio Department of Development announced Friday $83 million in
grants to cities and counties across the state from the Ohio
Neighborhood Stabilization Program to buy, demolish or redevelop
blighted or foreclosed properties and establish land banks.

The awards are based on foreclosures, sub prime loans, defaults, delinquencies, and vacancy rates, with the areas of greatest need receiving funding.

In addition, $29.2 million will go to the Affordable Rental Housing Initiative.

That plan encourages NON PROFIT organizations and PUBLIC HOUSING AUTHORITIES to redevelop demolished, foreclosed, or vacant structures into affordable rental housing serving households with incomes at or below 50 percent of the area median income.

Maybe this is why all the demos are happening - all the developers need more space so that they can grab some of this fresh cash and start building again. Ya think.

You all will have to take shifts keepin' watch over your beat up old houses - with that kind of money these guys will be out with their old tonkas tearin' down every building in sight. Better hope Samuel doesn't get a John Deere for Christmas.

NO matter how much money is

NO matter how much money is funneled into TWDC by NPI, Model Blocks Funds, Cleveland Foundation, Councilman Cimperman, etc., little if none will trickle down to the regular people and that is a known fact.

Another known fact is that Chris Garland needs to weave believable yarns before his nose starts to grow - I know we're all for urban gardens but nose growin' ain't what we're talkin' about. Board Minutes and Newsletters clearly puts TWDC in the driver's seat when it comes to the demolition of Frank's historical home. If Chris keeps this up he won't even be able to go back to good old Caramel, Indiana.

Day before yesterday, I provided a copy of the Update provided by our well paid Development Director/SII Program Manager Samuel Catania, wherein it listed pages of properties with completed construction/rehab work either finished or to-be finished - but with no addresses for validation, to a representative from the Near West Neighbors in Action Committee and the look on his face was of pure astonishment. "Just what we been looking for." said the distinguished man in black.

Further, I personally met with Ted Thelander last Friday evening and the discussion, which I am not at liberty to divulge, was that there are big plans underway for TWDC that will change the entire dynamics of an organization that has neglected the long-time residents and homeowners. That the Frank Giglios will again be able to walk down the streets in their right as a US Citizen and go into a place that was specifically created and organized to aid those with causes just such as Frank's without fear of being pepper sprayed or going to jail.

Frank Giglio

Hello all, I wanted to respond to the postings regarding Frank Giglio last week, I had originally posted on Tremonter right after the abuse of police power when Frank, Ted Thelander, and Chuck Hoven had the encounter with the police, when it was over with five second district officers were present. I signed up last week but it seems someone else used my name and posted something too.

That was not me, this is my first posting on this wonderful site. I had some medical issues regarding my mother that took priority the day after the City knocked Frank's house down. I was there and took about 15 minutes of video on the 9th. But anyway, I find it interesting that the Police showed up again to protect TWDC again. I am getting sick of my tax dollars being abused in this manner. TWDC is totally involved in what happened to Frank.

I had received several private emails regarding what I posted on Tremonter. The Second District Commander emailed me to tell me that when Frank was arrested that a sawed-off shotgun was confiscated from the property along with shotgun shells. This was not stated in the Plain Dealer story. I am really waiting to see the story in the Plain Press. I really want the truth to prevail.

TWDC staff encouraged the TWDC Housing Committee to vote to compel the Landmarks Commission to approve the Building and Housing Departments request for demolition. It was my understanding about 20 Tremont Leaders appeared to vote that night to demo the property. This was in June 2008. TWDC staff was at the Landmarks Commission to testify in support of the demolition. I personally testified to save the structure, but I was also critical that Frank needs to take care of business too. The structure was saved that day, but no-one was given any notice of when Frank went back in front of Landmarks Commission on November 13th.

This just is not right, I went to the TWDC Christmas Party last night for about a hour, some people seemed very uncomfortable. The first step to changing TWDC is to get new blood on the TWDC board, I encourage voting for seven new members on January 29th, 2009.

Getting Giglio's Situation Straight

Henry, it's not acceptable that someone else would use your name. If we are ever going to move forward in NEO we have to learn how to behave in the civic space. Certainly tearing someone's house down is not how to behave. What a cruel and unimaginative solution. Anyhow I am glad you stepped up to reclaim your name.

Reality

  I think that the Tremonter folks have hit a major nerve and TWDC, Joe Cimperman and many more clandestine players are using double identities to add confusion to the mix. 

There is only so much self-delusion that can go around, before the players see their true ugly selves in the mirror.  The REAL Tremonters posting here are holding the mirror to their faces.

Lucky's and Tremont Tours

  Lucky's used to be called the Timock Inn(sp?).  It was kind of a scary former steelworkers ' bar--where you would walk in and every one stared back at you with the "eye."  You had to be in really bad shape to end up there by the time I lived in Tremont in the early 1990s.  Steel wasn't happening.  LTV was hurting bad. It was a rough-around-the-edges crowd.

I rode my bike today and stopped by another former steelworkers bar, Zelezniks on Jennings Rd.  I wouldn't mind any one staring me down at Zelezniks, but when I walked in today, it was more like a dog lifting its head and then going back to sleep. They have a fire going and they're open 4-midnight Tues-Thurs and from 4:00 to 2:30 a.m on Fridays and Saturdays.   They have a wonderful wood stove and cheap suds, but it's kind of sad that the ole nasty crowd--smokers, drinkers, bikers...all of the rough- around-the-edges types don't quite fit in Tremont and at Zelezniks anymore.  Lucky's is a good reincarnation.  I keep waiting for a reincarnation like Lucky's here in my neck of the woods.  

So, in my round about way of saying it...Lucky's would be a good meetup place...to revisit the old and new Tremont.  If Frank has a pretty predictable schedule there, we might be able to post the opportunity for impromptu tours..say every Saturday at 1...or some other time that works out for Frank.

Hi Peter,

I'm assuming you all are familiar with current efforts to reduce light pollution? I did a delicate rant about this a few months ago, its pretty persuasive. It has been well established that light pollution causes numerous adverse health effects, one I'll mention here:

Researchers have found that exposure to bright nocturnal light can decrease the human body’s production of melatonin, a hormone secreted at night that regulates our sleep/wake cycles. And decreased melatonin production has in turn been linked to higher rates of breast cancer in women. 

But there are numerous articles to check out, below are just a few. In fact, this is such an important issue, an entire international organization has formed to call for the entire globe to turn off their lights for one hour, once a year as a statement of awareness. They are called Earth Hour and this year the day is Saturday March 28th, at 8:30pm, local time.

So I'm hoping whatever you all come up with, you will have the forsight to plan with this issue in mind. Also, I am hoping you all will realize that many Tremont residents are not as concerned with "add(ing) to the patron/visitor base" and would really just like to be able to live in their neighborhood.

ps - administrators - is there anyway to move this thread to a new or different page. It's a little ironic - Frank hates light pollution. He used to hang flags to block out the light pollution from grace hospital. (I know, I know another debbie does a downer)

When I moved on Roxbury I don't think a street light on my street or within a block on our cross street worked, and people around here aren't rich and stupid enough to run lights at all, if they don't need to - duh, kinda expensive and polluting, ya know.

Someone who works for the city told me they were fixing the streetlights and offered to put one in across from my house and I asked them not to - we like it as dark as possible at night. Living by a cemetery surrounded by people who don't waste money on night lights is a pleasure... dark and quiet at night... and just a few block from all the BS of the Big City.

If you're scared of the dark, don't come around my house at night.

LIGHTS OUT

I agree.  If the city keeps up with their job, the streets are well lit and if all the beautiful people want christmas lights on all year long, somebody'll start calling 'em rednecks.

Too much light hurts my eyes and I keep my lights off most of the time.  At night the sky illuminates the earth below and you can sometimes see the stars and I watch the planes go over, etc.  Too much light filters out the beautiful stuff - like the heavens, etc.

And I don't care how much funding they get, somewhere down the line it is going to be taxed to our electric bill - like it or not.  Nothing is for free.

If you want that much light leave your lights on in your own house.  Us old timers have lived here many years and made out just fine.  They want cameras, lights - what next, action?

Here "they" are committing amazing acts of unkindness to the residents of the Tremont area - possibly for a retread of the "Urban Renewal" social engineering disaster that was forced on the east side neighborhoods back 30-40 years ago, and they are trumpeting their pathetic cosmetic changes that they want to make to the neighborhood.

This isn't a simple case of putting lipstick on a pig, it is more like putting glasses and a mustache on the south end of a horse headed north, putting it under the mistletoe and expecting you to pucker up for a wet kiss.

There are 10 types of people in this world, those who understand binary and those who don't.

 sorry Peter! I think maybe I'm just not familiar enough with your sense of humor - so let me correct myself - Frank will probably lOve this discussion when he sees it! I noticed the above article in the TWDC newsletter this month, so unfortunately, they are nOt joking.

And thank you for using the term "urban renewal". That is precisely what it is and it needs to be called out for what it is. Obama is funding urban renewal in Cleveland. Someone might want to let him know.

And Henry, you know I love you dearly, but I gotta disagree with you on this one. There are areas that need lit, but there are areas that would be just fine without - for instance right outside my bedroom window. I swear I'm gonna take a bb gun to that stupid light.... Or the one in the backyard at my house in SoLo. It sits right smack in the corner of four backyards (I kid you not). It lights up my backyard like a parking lot and I can't get them to take it down. Imagine sitting out in the yard on a summer night - forget about candles - you can't even tell its dark. It also screws with my gardens in the back, they never get complete dark.

Trolling for Darkness

My main concern is in the areas people do not live, West 3rd. St., Quigley, Columbus Rd., Scranton down on the peninsula etc. Yes I reported them all but someone could easily get picked up leaving a Tremont nightspot while they are walking to their cars, usually about three blocks away from the nightspot. Then they get taken down to West 3rd between Jefferson and Literary to get mugged, raped, robbed or assualted. Take a gander down their at night.

Another dark place is French St. off of Columbus Rd. all the lights are out, when I canvassed that area I busted two Cleveland Plow drivers taking a snooze in their plows underneath the rapid bridge. This is a jump away from the downtown entertainment districts.

To give CPP credit they did fix when they did some of the work in January about 3/4 of the fixtures on Abbey Rd. between Columbus Rd and the Innerbelt Bridge, that was a dark wormhole going between Tremont and Ohio City.

I think you see where I am going.

Street lights -- CPP needs to be motivated

Hello all, I have taken on a project in Tremont on even larger scale since January 1st. I normally report monthly street light fixtures in my block club Lincoln Heights / Scranton-Starkweather on a monthly basis, but I seen how many lights in unpopulated areas coming in and out of Tremont, the Scranton Peninsula, Columbus Rd. Peninsula, and along West 25th from south of Ohio City to I-71.

Just in this area alone of Cleveland I reported 350+ lights that are out or malfunctioning. I had also turned in 65 lights in the same area that are on 24/7, and wasting electricity.

CPP looked at about 100 fixtures in the first three weeks of this year. They repaired 78 of them with new bulbs, they taped up 22 of them for fixture replacement (You see electrical tape over the bulb globe)

For the last month they have not touched another fixture, they committed to me to repair the remaining locations. I sent them to CPP repair staff via lists through emails. I was told last week by the management staff st CPP that if I want to see the others repaired that I personally need to call each light into their phone bank computerized repair number.

The mayors office followed with several reasons, like its to cold out for the employees because of their union contracts, and what else the Budget!!!!!!

So keep watching Channel 19 they are taking a lead role into shaming CPP, especially with execution style murders in the City with no lights. Please review the following links and stories.

taking back the streets, with lighting tactics

Did you ever think that the darkness is your friend in an urban environment? Simply, you light the places you want people to go, and keep in the dark the places you don't want a whole lot of traffic from outsiders.

Lighting on restaurants and coffee houses and other commercial community things make them beacons of refuge in the dark, welcoming places.

On your own turf, you control the goings-on in the dark. The streetlights make it so others can come to your place and act with more knowledge of what their prospects are there. In the dark, they are less confident and at your mercy. The resident has the advantage; the interloper is on less equal footing, in the dark.

Consider trip flares in the military tactic, and other sorts of overhead lighting, used to illuminate, to find and fix, the target.

One tactic we used with the drug boys on the corner was to put out the lights under which they plied their trade, counted their money, and dispensed their goods. Streetlights, overall, are not your friend.

By the way, why do we spend money lighting the freeways, when all cars also have headlights?

Due Process of Demos

And so...history repeats itself.....demos have a long history in Cleveland without due process! This lender won against the city for the reasons cited under appeal.

On February 4, 1964, appellant, The Pioneer Savings & Loan Co., an Ohio corporation, made a first mortgage loan to Maxine and Lester Zavelson for $27,000, covering a 4-story brick apartment building and the land upon which it was situated. This mortgage was recorded on February 11, 1964.

Sometime between September 8, 1965, and September 23, 1965, the City of Cleveland completely destroyed the building on the claim that it was a public nuisance. The City had previously given notice to the owner-mortgagors of alleged violation of housing ordinances, requiring remedying of bearing partitions, replacement of certain window panes and closet doors, painting of exterior trim, and repairs of exterior stair railings. It also alleged that the supply of heat in the building was insufficient, and that there was no water supply. By notice,1 the City directed the owners to obtain a building permit prior to remedying the above defects and inadequacies. Thereafter, the Chief of the Fire Department gave notice to the mortgagors that their failure to comply with the order of the City to make repairs would result in causing the structure to be demolished by the Fire Department, and "all materials removed" at the expense of the mortgagors.

However, no notice whatever was given to The Pioneer Savings and Loan Co., the mortgagee, which, a year and a half before, had loaned $27,000 on a first mortgage, and whose recorded mortgage was notice to the City of Cleveland of their interest in the building.

After the notice to the owner-mortgagors on April 14, 1965, the City completely destroyed the building, as heretofore stated, in September 1965, paying no attention to the rights of the mortgagee, giving it no opportunity to make the repairs in order to save its large investment, and totally ignoring its rights of record, which constituted notice to the City and to all the world of its interests therein.

On October 19, 1965, appellant-mortgagee filed an action for foreclosure against the mortgagors, Lester and Maxine Zavelson. On December 18, 1965, the Receiver appointed by the Common Pleas Court of Cuyahoga County to collect the rentals from the apartment building pending the foreclosure, found the building gone and, on that date, notified the appellant-mortgagee of such fact.

On February 7, 1968, Lester and Maxine Zavelson were adjudged bankrupt by the United States District Court for the Northern District of Ohio, Eastern Division.

On May 13, 1968, the foreclosure proceedings against the mortgagors were concluded, and the Cuyahoga County Court determined the balance owing The Pioneer Savings & Loan Co., including principal and interest, to be $36,987.91. On this day, May 13, 1968, at the conclusion of the foreclosure proceedings, appellant Pioneer Savings & Loan Co. purchased the land which was part of the mortgaged property, at the sale by the Sheriff of Cuyahoga County, for $2,470.79. The Pioneer Savings & Loan Co. has received no funds from any source on the balance due of its note and mortgage.

On November 21, 1969, appellant, The Pioneer Savings & Loan Co. filed the action in the instant case against the City of Cleveland, in the District Court, claiming an unconstitutional confiscation and impairment of its mortgage, by the City, without notice, process, or compensation in violation of the Constitution of the United States.

The case was submitted to the District Court on an Agreed Statement of Facts and, accordingly, there is no dispute between the parties as to any of the facts involved in the case. Both parties made motions for a summary judgment.

The District Court held that if the City desired that the repairs, which precipitated the destruction of the building, be made, the City should notify the mortgagee, as it might be the only party who could afford to make the necessary repairs, or the only party who could make sure that the necessary repairs were made. The Court held that due process of law under the Fourteenth Amendment required that the mortgagee be given notice of the condemnation of a building as a nuisance and that the mortgagee cannot be deprived of his interest in the mortgaged premises, without compliance with due process of law.

There was no notice given by the City to the mortgagee of the condemnation of the mortgaged premises as a nuisance, and of the destruction of such premises by the City. Such destruction was a violation of due process of law under the Fourteenth Amendment.

The District Court, however, held that although the mortgagee had been deprived of its property rights by a violation of due process of law, the mortgagee had not brought suit against the City within the four-year period of the Ohio statute of limitations, and that the commencement of such period of limitations occurred at the time of the destruction of the building.

We are of the opinion that the four-year period of limitations for the bringing of action under Ohio law, does not apply to this case.

The mortgagee had the right to bring foreclosure proceedings against the mortgagors; and the bringing of these proceedings, in this case, was brought within the statutory period. The mortgagors are personally liable to the mortgagee. The rule is that the mortgagor is personally liable if the mortgage contains a covenant to pay the debt secured, or if the mortgage is accompanied by a note. In many cases the mortgagee might recover part or all of his mortgage security by recovery of a deficiency against the mortgagors. In this case the mortgagee recovered $2,470.79 on the foreclosure sale.

Prior to bringing the suit against the City, the mortgagors had both been adjudged bankrupt; and appellant has received nothing from them as the result of such bankruptcy. The mortgagee had the right to demand and recover from the City the value of the property taken or destroyed without compensation.

The Court held that the property was confiscated and destroyed in violation of appellant's right to due process of law, in violation of the Fourteenth Amendment and with this conclusion, we agree. Appellant's cause of action against the City did not arise until after the suit in foreclosure had been terminated. "If upon the sale of the remainder of the mortgaged property there had been proceeds sufficient to satisfy plaintiff's claim, it would have no right of action. This action may have been prematurely brought, and as a result * * * halted until foreclosure action was completed and the credit of the proceeds of the sale applied to plaintiff's claim. Then, for the first time, the extent of the liability of the defendant was fixed." The Mahoning County National Bank v. City of Youngstown, 143 Ohio St. 523, 538, 56 N.E.2d 218 226. "The equitable cause in foreclosure should proceed to the final determination by a sale of the entire mortgaged property subject to the improvement; and whatever deficiency, if any, may then be required for the satisfaction of the mortgage security can be paid out of the damages secured against the wrongdoing defendants. In the meantime, the law action should be held in abeyance until after foreclosure and sale." City of Toledo v. Brown, 130 Ohio St. 513, 526, 200 N.E. 750, 755.

An action by appellant against the City, if brought before the action and decree of foreclosure against the mortgagors would have been brought prematurely. The action brought against the City was not barred by the statute of limitations. The City was guilty of violating the appellant's constitutional right of due process of law, under the Fourteenth Amendment, and is liable to appellant in the amount due and owing on its mortgage and note, including principal and accrued interest.

The judgment of the District Court dismissing appellant's complaint on the ground of the statute of limitations is set aside, and the Court is directed to enter a judgment for appellant in accordance with the opinion of this Court.

  The arbitrary application/prosecution of tax foreclosure and liens and the unlawful application of condemnation and demolition--coupled with strategic arson--has a long and inglorious history in NEO. 

It's a story worthy of coverage in our local rag, but it is not happening.  And so it goes, in Gotham City...

OK..the Thursday 3.18.2010 night fire near the Cold Storage building after Fred Finley just got his property back..., of course, nothing suspicious there.  And, the intimidation of Guy Templeton...ditto. 

And, the rumor about the hood that TWDC's own code enforcement officer is shaking down businesses for "donations."  If it wasn't REALNEO...you might think it was a bad episode of the Sopranos...
