FYI:

The county recently filed a tax foreclosure on behalf of the Board of Revisions against Frank Giglio's property. ( see Cuyahoga County Civil Case No. BR 01 002401) 

According to the County Auditor's Office, Frank owes $ 181.48 for parcel # 004 10 028 and $ 1,236.66 for parcel # 004 10 027.  A couple questions quickly come to mind:

1.   Of all the empty, vandalized eyesore properties that are filling the streets of Cleveland, why the rush to foreclosure on this property?

2.  The inspector that I wrote about in the past concerning his bully attitude as well as spraying flea spray in the eyes of Frank's cat, good old Richard Huberty, is now a convicted felon. Good old Dick was one of the inspectors indicted in the Federal Corruption case.  Since he is now squeeling on anyone that he can, he should really step up and be a man.  He should tell the truth about the Frank Giglio ordeal.  Considering the corruption in Cuyahoga County and the City of Cleveland Buidling and Housing, the FBI needs to investigate this sickening case.  Old Dick needs to be questioned to find out why Frank was constantly harassed by Tremont West, Councilman Cimperman, the Building and Housing Deparment, etc.  Kinda makes one wonder what kind of bribes were taken and who wants this land so desperately.

I am a former, long term employee of Cleveland Housing Court, and I met Frank Giglio about 15 years ago at this court.  He has been harassed by the city and councilman for a long time.  He was sent to jail and had a one million dollar bond at one time.   A much higher bond than most child rapist, murderers, etc.  His yard was bulldozed, he was spray maced in his face, taken to jail and his dog to the APA.  He has been incarcerated many times over this house.  I personally seen one of the housing inspectors spray flea spray in one of Frank's cats' eyes.  I also witnessed this same inspector bully and threaten to hit Frank.  I helped Frank clean every square inch of this house to save his belongings from being dumped in a dumpster.  This house needed repaired, but the house was a very beautiful home with tile fireplace mantels, unbelievable wood work, etc.  It was a very solid home and did not deserve to be demolished.

 

Unfortunately, Frank did not fit in with the councilman's vision of Tremont.  There are three homes directly across the street from FRank's house that have been vacant and boarded up for at least 20 years.  Why couldn't this house sit the same way?  I have been Frank's friend for many years and know for a fact that he suffers from severe mental health issues.  The court, city and councilman are all aware of his mental health problems.  Aren't we supposed to look out for people like this? 

And to stip his house of firplace mantels, windows, doors, etc., before they tear the house down? What kind of BS is this?  And the poor guy had to go to jail again over this.  Unbelievable.   Now the councilman and others involved can now take the land as they have desired for so long.

the repairs had been done

I think it important to say (again) Frank had completed new flooring on the front porch, painted the entire house, reshingled the roof and replaced the gutters. If you look at the photos of the demo, you can see a house in reasonably good condition - better than maybe 40% of houses standing in Cleveland as a whole.

And I'd also like to mention that the actions of Councilman Cimperman, TWDC and the city greatly affected Frank's disposition. After the razing in '98, he really struggled to come to terms with what was done to him. He wasnt necessarily hostile about the whole thing - he just wanted to be left alone. So he complied with what was asked of him. All he ever wanted was to just be left alone. I do disagree, lmiller, on that. Frank is one of the most sane people I've ever known. He handled it better than I could have.

Who is looking out for Frank

It occurs to me, now that the city has destroyed a man and his animals' home, is anyone looking out for Frank and his animals? Is he homeless and does he need shelter, food or other help. Is there a way people may show support or love?

I'm deeply saddened by all of this and offer my love and support, Frank.

Frank is homeless and in desperate need.  Can you believe that "Councilman Simpleton" used to advocate for the homeless?  what a joke.

People need to look out for the elderly, mentally/physically challenged, and children.  He lives off of a minimum SSI check.  I had to buy him shoes and socks in the past, and I also visited him at the end of many months to buy him food, cat litter and pet food.  Obviously the man could not afford to make repairs.  

I hope that others will also volunteer to help Frank.

Yes, Frank did make numerous repairs to his house.  Some of his friends that helped Frank clean the interior have several videos of the entire inside of the house.  I believe that the majority of Frank's severe mental health issues were defenitely aggravated by this entire ordeal.  He is saner than I would ever be.  :)

Frank Giglio redux for Fred Finley

This time the owner of property wanted by the State of Ohio had more wealth and a plan to create housing in the cold storage plant next to the Inner Belt structure.  He was assured that his property was not needed to allow the Inner Belt construction to proceed, so he went ahead with his proposal.  And then some folks changed their minds---and the city quickly began to issue citations for the building, and to condemn the building and threaten to proceed with demolition. 

Sound familiar?  The cold storage property owner is Fred Finley--he is an African American businessman.  So, this time the taking will be more apparent as Congress representatives Dennis Kucinich and Marcia Fudge realize that it will not be as convenient to label this man, crazy or delusional.

 The building was sold to businessman Tom Embrescia who owns the firm that makes money from the building's billboards. Finley said he and the state are about $3 million apart. He wants paid for the building's best use value, not for an empty pile of bricks. And he wants compensation for money lost because of the state's about face. 

Tom Embrescia is represented by attorney Tony Coyne.  The same Tony Coyne who sits on the City of Cleveland Planning Commission...stay tuned.

Reading over these comments and the posts at Tremonter...a common desperation can be found.

We know that this behavior towards a flesh and blood neighbor such as Frank Giglio, is deplorable. It is not right-- it is, dare I say it?--EVIL. The whole swirling nightmare is all the more terrifying, because those in charge SEE someone like Frank as a "problem." Their "solution" is chilling.

Today in America, it's not about helping your neighbor. It's about finding every last opportunity to make a buck off of every conceivable market condition. It's the REO "investor/developer/flipper", who goes home every night to his/her existence with no remorse for the many properties manipulated in a day, like a chess board that controls human lives.

The arcane economics of federal bailouts and county land banks will not save us from this mentality--this detachment--that includes putting money in banks (and the "promise" of LAND BANKS) that have abandoned communities.

I don't have a degree in economics, but I know enough to know that a system that "seizes" property from poverty is killing us. I don't have the answers tonight, but I only pray that I can keep my job and help someone else keep their job...so that we can start helping each other keep our homes in a place worth living.

You certainly won't be reading about any of this in the Cleveland Plain Dealer... they don't have any economists on staff, and don't seem to have many good ones in their rolodex (which is probably the technology they still use for tracking such things)

Good question.  I think this is called "theft."    I do not understand how Frank could owe Tremont West anything.  The City collects on demo fees, etc. What gives them the right to steal Frank's stuff after they have him thrown in jail?  I think the FBI needs to investigate further county/city corruption by talking to former residents of TRemont.  Where did all of the poor people go that once lived there ?

I think you are right! The value of the lumber and millwork is probably in the $10,000s, making the theft a felony.

Was the house recylced? The Cleveland Foundation's Lillian Kuri was just bragging about the building recycling program they fund, and that they are going to scale it to 500 homes - they are recycling one now. "Entrepreneur for Sustainability of the Year" Chris Kious of Cleveland Foundation supported A Piece of Cleveland may attest to the value of Frank's house, even deconstructed... so may NEO Mainstreet's Joe Stanley, who participated in the first Cleveland Foundation funded house recycling project last summer.

Find out everything you may about the demolition, who was involved, and where Franks assets are now.

I am going to talk to Frank, file a police report and visit with the city prosecutor's office.  From what I understand, all of the criminal theft activity is on video tape.  There was NO court order to remove any belongings from Frank's house.  The house was to be demolished "as is."  This is theft, and I can promise everyone in involved in this will be prosecuted. We have pre-demo video tape of the entire inside of the house, including beautiful wood and tile fireplaces, pocket doors, doors, windows, etc.

I can tell you the theft was $10,000s if it included historic architectural features like that. Find out who has the stolen property and they should be prosecuted for receiving stolen property, as well. You may want to look around Detroin Shoreway, where they want to steal your property and soul as well.

A lot of folks don't like it, but I call it like I see it - they took his home - they stole his property and all he could do was stand and watch - under police guard - no doubt - what kind of compassion is this - they need the FBI - and any body else that will come in and take at the look at the records and investigate - follow the loot and find out why the poor long time residents of this diverse ethnic and let's not forget to mention Historical (histerical) district)  neighborhood can only get miniscule handouts and a truck load of free food - from time to time.

I have a meeting with Commissioner Jones and others to review the Star Neighborhood Development collaboration with Joe Stanley, Maurice Small and Richard Fleischman to significantly change the landscape of local food here. It is very easy to fit Frank and his property into this plan, which I'll attach here and explain in more detail shortly.... it is over two Mgs... sorry for the large file size.

The meeting is downtown Wednesday, December 17th, 9 AM, and will not include any of the usual suspects, nor anyone responsible for taking Frank's property away. It will include people who will help Frank get his homestead back and prevent this from happening to others.

I'd like Frank and a friend who promises to help Frank get his property farming, if he has such a friend, to join me for the meeting, if they like. I can pick them up in Tremont at 8 AM - I'd be happy to meet in advance any time to discuss this further. I am serious.

Norm - don't discount Frank from this equation

I spoke with him today about the posts going on here and he is bemused. He mostly needs an attorney right now, but be assured he is not crushed and appreciates the support he is getting here.

He asked for a print out of the board relating to his situation. Anyone else is welcome to beat me to the punch! Just leave it on his lovely announcement board out front - he'll get it. Post something if you are going to do it, I'll save my resources for other things if you do.

His old property is  looking forlorn, but he has managed to add a touch of grace to it already... I have a few shots I'll put up tomorrow... :(

Animal behavior and the Human Condition

Take our dogma out of the equation and you have animal stories.  Fairy tales and parables told for thousands of years--Anansi tales, Aesop's Fables, Dr. Seuss, and other mythologies.  Why is the owl wise?   Because, the owl SEES all.  Can animals ever learn to share??  I know that animals do not live to play games and they certainly don't have dogma and doctrine.   I am a librarian so I will advocate a book here--The Shock Doctrine: the Rise of Disaster Capitalism by Naomi Klein.

Our respective dogma will not SAVE us from our animal behavior...These dogmas all have their wisdom, but they should not be used as justification for predation.  We need a new mythology.  We need to learn to share.

I just want to say thank you for everyone who has shown such sensitivity to this situation in your posts. Its a very frustrating circumstance and its saddening. I think it is very important not to let this incident go without widespread notice.

Hopefully, this will bring about change. Hopefully, the players in this cruelty will realize some shame and guilt for what they have done. Their hearing from others in this regard will help that occur. Apparently they weren't brought up with those values, but I think there is still hope that an awareness can be brought about in them. I mean, we know a sense of generosity, compassion and love would bring them the personal happiness they are so deperately (and erroneously) seeking.

I saw Frank briefly last night. He looks good. He has a stronger soul than most, I think.

Thank you dbra--you and others at Tremonter.com, who have provided valuable community insight. We are all trying to sort out this mess and it takes courage to speak out.

I know that I have a bad habit of constantly switching my thoughts...but, bear with me, because there is a method here. Tremonter.com is a variation of the platform Cuyahoga County uses to run their website to convey information. Recently I noticed the City of Cleveland's Public Health site received a make-over:

I will be watching it to see how the Jackson administration extends this makeover to other departments...but I am also confused: Which standards apply?

Health standards go beyond paternalistic tripe and a rationale that justifies the behavior we witnessed against Frank Giglio--- behavior justifyed by administrators as "protecting" someone from "themselves" or a general abuse and selective enforcement of health standards, because "some one is poor" and can't "afford to take care of themselves."

Matt Carroll the adminstrator of this department knows that he needs to uphold standards that protect everyone. I am personally not happy that he and others who came to power under the Mike White administration have forgotten some of those standards.

Coleman changed her vote... Demolition was approved

Might as while start compiling the names behind this demolition. The PD article you link makes clear it was the vote of Cleveland Landmarks Commission member Jennifer Colemen that pushed the demo forward. She is a very "made" local architect, funded by the Cleveland Foundation... I've thought of her as a smart up-and-comer but I can't say if she is in fact good or evil, or if she should be on the Cleveland Landmarks Commission. Of course, there were other members who must have voted for demo and we must obtain their names. Also, considering the poor performance of the Cleveland Landmarks Commission representing us in dealing with the Breuer, it is safe to question whether any of the current members should be allowed to remain, and it is safe to say the way the Cleveland Landmarks Commission is appointed should be challenged, as it has led to such poor outcomes for the public.

The best way to determine the role of members of Cleveland Landmarks Commission in any of this would be for them to offer a public forum on this demolition, and for the members to participate in open discussions on the demolition, like this and at Tremonter.

Further, I have not seen any mention of the obvious involvement of people with the local Preservation Resource C

Maybe I'm misunderstanding your statement, but Tremonter runs on Drupal, and I don't know of the county using Drupal for any sites.

  JeffS--I am not a man-behind-the-curtain a la Wizard of Oz.  I have no idea how the new county health site and city health site are structured, but they LOOK like Drupal...Can you tell us more?

Many tools for building community-oriented or multi-functional websites use similar components underneath, or have functionality that has been built to resemble preexisting. Out-of-box Drupal sites become unmistakable once you've looked at enough of them, but at surface glance, or with more customized sites, it can be harder to tell.

GreaterCleveland localhealth.info was built with a content management system called Plone. There's a little badge at the bottom that tells me so. :)

A lot of the dynamic content on the Cleveland Dept of Public Health page links to pages that end in .aspx. ASP.NET is a Microsoft technology.

If you're trying to ID a Drupal site, an easy (but not foolproof) way is to view the page source and search for Drupal. Often there will be CSS or JavaScript files included that have drupal in their titles.

I think they all should be forced out into the open - everyone who was involved in taking Frank's property - if they are not made to answer for their dirty deeds they the matter goes un resolved -  everybody knows that someone is after the acerage - and that the cost of the demolition will be added to the land tax bill and if Frank is unable to pay - the city will then take the property for the taxes - etc.  How about everybody pitching in, even pennies and helping to pay the bill so that Frank can have a Frank Giglio Nature Walk - with trees and plants for birds and butterflies - with benches so he can go and sit with his dog and enjoy his coffee - If it is deemed a nature park no one can ever take it away.  We could beat the city at their own game.

Let's also hope that the Plain Dealer reporter Mike O'Malley avails himself to the photos of the house that do exist on RealNEO and in private collections. You can track some of these photos down very easily. Afterall, not all of the evidence can be buried...so easily.

I just finished The Good Guy by Dean Koontz. One of my friends expressed surprise that I would read a book by Dean Koontz...

("a republican!" and a dog lover. FTR, librarians are widely "regarded" as cat people--YES, this IS a reference to the PD's description of Frank Giglio as mentally ill, eccentric, "dazed and confused."  Well, JMurray--guess what! I like dogs, too :)

I can't reprint some of the gem insights provided in the book. You will just have to read it! Note the comments made by the psychopath on a what constitutes a "psychologically mature" person on p. 189 and the final paragraph on light and darkness on p. 386.

I am fairly confident that I have not violated any copyright laws with this admission...and remember, you can generally find books and form your own opinion at the library...for the time being...(and my gratitude to Dean Koontz here for this book).

It's Frank's Land... Let's Help Him Farm It Again

It sounds like the less the TWDC and other establishment folks know or do about this going forward the better. Their work is done, and it sucked.

From what I've read, the first attack from the city upon Frank's historic farmland was 10 years ago... that was the beginning of the end, as the city took away from the visionary Giglio the means to feed and support himself that we now call Urban Farming. Frank was a forefather of what is now a movement farting its way through the large bowels of our establishment that just shat upon Frank. And establishment shit ain't fertile.

I'll help Frank make his property back into an urban farm, and I will help him fight for more land to farm if he needs it, and I'll even help him get workforce to help with the farming. His land may produce up to $5/square foot per year being farmed, and Frank farmed it before the City of Cleveland stole his farm. I believe he deserves his farm back.

Joe Stanley can design Frank a new home, and we may build it with recycled material from other demolitions in the area.

Where is the millwork stripped from Frank's old home - where is the lumber - was it stolen by the city?... Preserved?

It would be a good use of public money to prepare Frank's land for him to harvest, but I'm sure we can easily do it as well with just community support... I'm sure Frank will share with us his bounty... he could probably grow $100,000 worth of food a year, there, and sell it all right to the restaurants that feed the yuppies who are ruining his life.

How many square foot of land does Frank own?

I think Frank needs a lawyer to help him sue the City of Cleveland for the lost value of his food, the past 10 years, and his losses in the past few weeks. The rest of us should help Frank rebuild.

I'm meeting with Commissioner Jones Wednesday about an urban farming strategy for Cuyahoga County and I will include Frank's property in my proposal, if Frank is interested in this. Will someone check with him and report back

I'll be his first customer when his harvest comes in.  I love home grown food.  He could have a little produce market right by the road and - gosh, he could make a mint - people in the neighborhood could walk to the garden store.  In the winter time, he could sell Christmas trees, and evergreens - Frank could have just stepped into a gold mine.  And with the help of his neighbors righting a terrible wrong he could shine again.

How big is his lot and where does he like to eat?

If we can determine how big is his property we can approximate how much food he may grow and how much he may earn.

If there are some restaurants or markets or even neighbors in the neighborhood that Frank likes and that like Frank, we should make arrangements for them to advance Frank food now, in exchange for an equal share of food from Frank's property next Spring, Summer, Fall and Winter.

It's ironic that we're up in arms about someone else deciding what's right for Frank's property, yet already planning his farm and garden store, what he'll grow in winter, what trades he's making, whose chickens he's tending, and who's buying first...

He used to have a garden, sure, and it might be a great use of land, but the point all along seems to have been that he has just wanted to be left to his own devices.

Funny you should mention that. We want a real X-mas tree this year, which will cost us $20-60 and probably come from Canada, and be spray painted and months old, if we buy it from a lot. We don't want to drive out in the country to cut our own. We are going to see if we can find a tree growing in some wasteland here, that should be saved from toxic torture, but we would be glad to pay Frank or anyone in Cleveland what we would pay at a lot or cut your own place to harvest a Christmas tree from a local lot, if anyone has a tree to get rid of.

We also wondered if there are any trees growing on lots being bulldozed, which could be saved before the carnage. Many of these abandoned and forced eviction houses had nice landscapes.

If Frank doesn't want help he doesn't want help. We'll know soon enough. Some say some people must be homeless... choose that lifestyle... perhaps Frank wants his life this way, in which case we should all leave him alone.

However, people of REALNEO, if my family and I are ever homeless and starving, I give you permission to arrange some help, and be as creative as possible.

The model of helping people save their homes and lives by growing food on their land - and government and society helping them do that - is as fundamental a concept as imaginable... that we do not already make this happen here will now be corrected.

One lesson I learned from Ed Hauser dying in poverty because not enough people asked if they may help him, or agreed to help when asked, is to ask people if they need help before they are dead.

I think that we all need to keep in mind that Frank is homeless.  Another Tremont tragedy.  I am more concerned about Frank having a place to live.

Let it be known that no one is trying to force anything on Frank or run his life for him - we, I want him to know that he has support, that he is not alone and that his friends and neighbors have rallied around him and people are on his side - a lot of times that makes a difference - Frank is not a charity case - he's a US Citizen  - he took this better than most - and when our own government allows such nasty goins-on it shows that Americans stand up and fight back for citizens like Frank -

The .21 Acre Historic (now, for sure) Giglio Farms

It appears Frank owns parcel 004-10-028, which is 4,738 square feet, and parcel 004-10-027, which is 4,720 square feet - 9,458 square feet - a little over 0.2 acres. That may easily produce $50,000 in food.

It appears there is property next to his that is not developed and is wasted growing grass... who owns that wasteland? It would be reasonable to add that to the parcels of the Historic Giglio Farm... kick Frank's prioperty up to .5 acres, to produce more food value to the community, and reduce mowing costs for the owners, probably being taxpayers.

Since we are putting urban farms on blighted land in the area, may I suggest we farm the disgraceful Grace property across the street, as well.

And, perhaps Frank may live in one of Grace's blighting board-up houses until Frank may find a new one for his lots?

Anyone know a good Christian there to ask? It is Christmas time.

Whether he likes it or not, Franks life has been turned to garbage. To turn that to gold, Frank needs to make arrangements with all the Tremont restaurants and residents to build the largest compost pile in Cleveland, where his home once was. Put word on the tremonter and everywhere - all appropriate food scraps in the area should be brought to Frank for his compost pile. Very quickly, he will have a huge pile of fantastic soil, which he will need to grow a future there.

One advantage of being a preferred pioneer in an urban neighborhood should be that Frank gets first pick of the garbage around him, and there is lots of garbage. He may turn that to gold.

Perhaps his entire business should be sitting in a new house on his lot, collecting such garbage, and selling the soil produced?!?!

Maurice Small will help Frank determine all the ways he may make his land productive, as best fits Franks desires, but it will begin with compost, so people may start helping Frank by preparing Tremont to give Frank its scraps.

Norm, you 're my kind of guy - but I have one question - I know that Cimperman and O'Leary are right in the middle of this mud - but where does the Moss Organization fit in - he seems to be running' things at TWDC.  (behind the scenes) I was present and have it on tape where he promised O'Leary credit for the housing code violation round up - what kind of credit is he speaking of?  anybody want to guess - and seven days later it was decided that Frank's house would come down. I think TWDC has left a big big thumb print on what happened to Frank's house - we can't leave out our local bosom buddies.

I have known RIchard Fleishman through my parents since I was a kid and asked him to work with me on the Coventry Elementary School redevelopment because he designed that school in the first place, and he is a very creative and experienced "big vision" architect and planner. Because he is all that, and personally inspiring and enjoyable, we have worked together further with other partners developing a local foods plan from scratch, allowing us to include people like Frank and his property.

Commissioner Jones has been in the loop on this for months and organized a meeting of the Coiunty people needed to transform local foods here - I doubt any of them have had direct involvement with the Giglio affair and if they have that will come out and be addressed.

Our focus has been on the 9th Ward of Cleveland and East Cleveland for many reasons I'll leave to later discussions, but the planning is county wide so adding activities in Tremont is intended and timely - Frank couldn't be more welcome, and he will get "Founders" status in whatever develops.

I am a socialist and entrepreneur more interested in the "Ed Hauser" Citizenship concerns of all this, than anything else. I live in East Cleveland and am investing here, so I have no plans to "own" any of Tremont... I buy art there and anjoy your history and people and that is as far as my neighbiorhood involvement need go. Oh, and I hate the toxic conditions you are subjected to, and spewed from your neighborhood upon the rest of us, and the lead in your homes and environment, and am committed to eradicating all of that.

I don't know any of the people involved in the war there. But I know Richard Fleischman is related to the Moss of whom you speak, and I made Richard aware of the public concerns swirling around him and asked him to make Moss aware, and suggested we all figure out how things have gone so wrong.

Some people besides Fleischman I know say Moss is a good person but I do not know. And I can't judge what I don't know. But I am committed to getting to the bottom of what is wrong with this community, wherever that may be.

It is clear there is a tangled web of self interests and incompetent and poorly socialized people at play here and many people must be eliminated - entire organizations must be eliminated or restructured - government must be restructured and people must be removed from office. I'm not afraid to say all that, and to work hard to figure out the problems and problem people to be eliminated and restructured and help others do that.

There are plenty of good people here, and with open technology like this we may work together for change here. We may not be silenced.

2 homes on Tremont demo list

There are two homes set for court hearings in January. They have been condemned by the city and slated for demo. Th one owner has no idea how the inspectors gained access to the inside of her property to inspect it for condemnation; received no prior notices other than a demo notice; and the address on the notice lists the front house, which has just completed full rehabilitation.

There are several other errors on the  TWDC List given a cursory glance. The home I live in is cited as "undergoing rehab - check permits" (its nOt undergoing rehab, I can assure you); the home I used to reside in is cited as "vacant" (it has not been vacant in four years). I do not know why they would put these two properties on the list. I assume it is not for purposes of silencing me

I suggested to John Moss, Sammy Catania, Tim Jenkins and Ron O'leary, at the last housing committee pre meeting (they hold the violation list review 30 minutes prior to the housing committee meeting - you must be told this in confidence to know about it - its not posted anywhere) that perhaps it is not a good time to step up citations given the current economic environment. I pointed out that given the current credit crunch, many residents are no longer bankable and will not qualify for the repair loan programs the city offers (several of these guys are in the banking/investment industry so I'd like to think the reminder not necessary). I received only mumbled replies.

I forwarded to the group a list of 0% rehab loan programs in other cities. As many are already familiar, these programs for low and moderate residents offer a loan for the cost of the repairs at 0% interest. The principal remains attached to the title and is paid back when the home sells, is refinanced or the owner can make payments.

A program of this type would be the stop-gap that would prevent Tremont residents from losing their homes because of the code enforcement, TWDC would see the homes repaired. everyone wins.  

The problem will be that much of the financing for these programs comes from federal funds and TWDC has an unarrested penchant for spending federal funds (HUD, Block Grant, etc.) towards the efforts of developers. I would say almost exclusively towards the efforts of developers. Perhaps its the neighbors' turn to receive some of the funds meant for them? But then TWDC needs parking lots for its Strategic Investment Initiative as proposed to NPI. 

Given the dire economic predictions and TWDC's unwavering desire to cleanse Tremont of any and all porperty code violations, we could be witnessing the wholesale property divestment of numerous Tremont neighbors, not just Frank.

We are in the process of creating a slate of candidates for the TWDC Board election to be held next month, 1/29/09. Their platform will be based on principles of Social Equity.

PLease help out - anyone who lives OR works in Tremont* is eligible to vote. They must register at the TWDC office by December 24th (8:30am - 5pm, 2406 Professor Ave). This involves filling out a simple postcard with name, address, signature & phone/email (if they tell you they don't have any right now - as they have others - please be persistent, or contact us, we have extras).

BUILDING AND HOUSING

That's a good question?  How did they gain access to the property since the doors were locked and the windows were fastened down?  I've been trying to uncover this as well as other mysteries about this property since I learned of the search warrant posted on the buildig weeks ago.  Following the date lines, the amount of money, the fact that this property owner not only resides in the one beautifully finished house, but that she is a long time resident and a business owner in the neighborhood, and the hard work she has put into this property - why did they go after her at this time?  My investigation also revealed that there had been no citations issued in the past 12 months - that a recent exterior permit had been pulled for the house in question - I have made numerous calls to the inspector and have received no response, have contacted the building and housing department  - inquiring as to procedure for a condemnation order - was transferred to about six different numbers - finally received a call from a Mr. Tyrone johnson who went through some basics but as soon as I informed him that I was doing an article for the plain press - he clamed up and said he wasn't allowed to give me any answers - that I had to contact a number at the Mayor's office - I inquired as to why? Would not the answers be the same? and he just replied that I would have to call the number I was provided which I did and at this time - I will be making a visit to the noted office for as I am told, if the good inspector did somehow get inside the building - to write those 20 some plus detailed violations there would have been pictures.  Under the Sunshine Law - ORC 149.43 public records must be made available for inspection. 

This lady has suffered breakins, thefts, had the big new windows that she put into the new store front broken out - and now just out of the blue - they condem her house - "another frank situation perhaps." 

To address John Moss' interest in this equasion - he is no longer Chair person the the Housing Committee - that being so - what is he doing conducting secret meetings of any type at TWDC - In the September issue of the Plain Press, RESIDENTS RAISE CONCERNS ABOUT STEPPED UP CODE ENFORCEMENT IN TREMONT - by Chuck Hoven, Mr. Moss makes it perfectly clear as to his intentions - and he has no empathy for the poverty stricken, the elderly or the low incomed residents of the neighborhood.  Even though Mr. Moss himself has been advantaged according to county records by a two family dwelling on West 11th street that he managed to gain title from the Famicos foundation (a foundation established for the neediest of famlies) for the good price of $0 and a second home from the Cleveland Housing network for the measley sum of $20,000 - while he was off managing Merril Lynch assets in the One Hundred Ten Million Dollar range and Turner Construction projects in the One Hundred Million dollar mark.  (Chech out his Bio on helenmoss.org)  Some of the poor people I know in this neighborhood are happy to just be able to feed their families in this day and time and to have a roof over their heads, a place to keep their kids together and safe and warm means everything - what kind of a j............s would get behind code enforcement and cause undue hardship and add additional financial stress to families - causing them additional worry - when he comes from the wealthiest of families - he should be run out of town - I don't care how rich he is, what kind of business man he is, what kind of education he's got - you know - YOU CAN'T BUY CLASS WITH MONEY!!!!

Why is there a Carney on the Board of the Cleveland Foundation... her bio is not impressive... interesting to read "Appointed 2001 by presiding judge, Cuyahoga County Probate Court". From the Probate Court website:

The Probate Court is established in each county of Ohio to supervise the administration of the estate of a decedent who was a legal resident in the county at the time of his or her death. Each transaction involved in the administration of an estate is subject to the examination and approval of the Probate Court.
Other matters within the Probate Court's jurisdiction are: issuance of marriage licenses, adoptions, guardianship proceedings, the involuntary commitment of the mentally ill, and land appropriation cases.

Sound a bit dangerous... "involuntary commitment of the mentally ill, and land appropriation cases"... seems the only strategy at play by government in dealing with Frank and his property. Go to Probate Court and see if they have a file on Giglio.

And them ask yourself, why are any of these people on this board, if it controls the quality of government and life in our community. Looks like the usual suspects who ruined this community.

Seems the Cleveland Foundation probate expert Tana Carney is connected in some way to the political kingpin of our Port Authority - James Carney... the man singularly most responsible in the death of Citizen Hauser.

1 of the 2 on the demo list

I am one of the two houses on the next to demo in Tremont list.  I filed an appeal.  However, my compliance date is 12/20/08 and the city wouldn't give me an appeal hearing prior to the compliance date. 

The violations on my search warrant were met with a pulled permit as per a City of Cleveland attorney.  The permit should have stayed the process, he said.  Four days later, my property was condemned anyway.  The condemnation order has fictitious violations in addition to the original violations.  I have pictures proving these facts. 

According to our last housing meeting, it is viable that while I'm waiting for my appeal hearing on 01/27/09, my house could be torn down any time after 12/21/08.

The property/parcel on the demo list?  Not the house on the original search warrant, but the home I just put the final touches on it's renovation in mid-November.  Not sure how to, but I could post pictures of the finished product for everyone's review...

The process to stop the wrecking ball?  Not very clear.  I pulled a permit, which according to some at the City - is an automatic stay.  Regardless, my home has been condemned.  I filed an appeal, which according to some, is also an automatic stay, but accoring to B&H at the Tremont housing meeting - neither of those things matter. 

And I was told that the City doesn't have to go to court to tear down my house.  And if they choose to tear it down... they'll mail me a letter.

So, theoretically speaking, it is very possible that my house could be taken down without me ever getting to say or do a thing about it.  No day in court??

I am, however, waiting for a followup call from Building and Housing...

In the mean time, I have pets, tenants, and our entire lives are in that building.

I saw the contractor taking belongings out of Franks Giglio's home.  Am I and my tenants to suffer the same plight?  Is some contractor going to roll up and take my antique stove?  My power tools I need to make a living?  My tenant's business?  My other tenant & his girlfriend's entire life?  I mean, just how does this thing work?  Do we then get to see our things posted for sale on Craig's List???

Do you have any idea how it feels to roll the paperwork of this story out in front of someone and have them respond, "move out anything you care about..."  Damn it.  That's my home and I care about all of it... and I don't have that much to begin with..

I do have a second house on the anterior property to start fixing in the spring.  It doesn't look great, but it is in better shape than the one I just finished.  It is also secure and I own occupy the property.  No one is getting inside, the door is secure and the windows are screwed shut.  The structure is sound. It is no threat to anyone.   And besides, the Gospel Press sat vacant for an extra couple years.  No one posted a search warrant there and commanded 30 days to renovate - and people broke in there to adventure all the time... (risks? danger of falls? health issues with the standing, stagnant water on the third floor?)  I love the Gospell Press project and as a neighbor, was more than willing to support the extra time they needed to get this project done.  But I'm being slammed for reasons that were very real to their project.

Further, I checked with my immediate neighbors - based on the success of Phase One, they would like to see Phase Two completed and housing more Clevelanders.  No one is more impacted than me and my immediate neighbors.

So, while I wait for my return call about the state of my home, I can't help but ponder:  Due process?  Proper service?  Where is my day in court?  Democracy?  Constitution?  Bad Economy?  More pressing city issues? Hello?

Jeff will be joining me for a meeting with County Commissioner Jones Wednesday and that would be a convenient time to get his opinion on how to handle the matter, if the county may be of assistance.

Des presented her situation (very well) to Ron O'Leary at the TWDC Housing Development Committee meeting last Thursday December 11th. I was stunned at his response, or lack of it to be more exact. An approprate response to someone reporting to him that her fully rehabbed home has been comdemned and on a demo list would be "Thats incorrect. I will correct it." Instead Des got unitelligible mumbling.

They were equally inept at explaining how the "inspector" made a detailed list of interior "violations", never having stepped foot inside the home.

I would be worried as well. Des, does your property sit in the way of an access route to the "pretend" parking lot TWDC will be (wish list) installing for the new Gospel Press Lofts?

Thank you!  I love this place.  It was such a mess when I started that it should have been torn down, but the bones and character of the house were too good to destroy.

I've had old timers in the neighborhood come to me in tears, happy to see it was saved and not bull-dozed for the next four story townhome..  their family and childhood memories are here.  Moon, one of those old timers is here today because his father first caught sight of his love at the counter of the candy store that used to reside here.  The original, main structure of the house was a small farmhouse predating 1880.  The surrounding land later became St. John Cantius, St. Peter & Paul, the Treehouse, etc.

It was a very difficult project and I sufferred more than my fair share of crime and vandalism which extended my project, otherwise, the back house would be done by now.  The back house looks bad, but it is nowhere near as bad as this one was and it has been fully restored. 

I camped out at City Hall a lot this week.  I think I finally have 716 off the demo list and now I'm waiting to hear the status of the house that has yet to be renovated, 714.

We actually spoke yesterday.  I recieved several phone calls and e-mails regarding home owners being targeted with search warrants for minor violations.  Then they receive condemnation letters followed up with demo orders.  Some of these cases went only 30 days from search warrant to demo list. No court dates, chances to defend themselves, nothing.

According to ORC 2933. 21 (f), the existence of physical conditions which are or may be hazardous to the public health, safety, or welfare, when governmental inspections of property authorized or requiredby law.  This is the requirement for search warrants.

I drove by the homes that have recently been served with search warrants, followed up with condemnation letters and put on demo lists within 30 days.From the exerior of these properties, search warrants should have never been issued.  Can you believe that the city can get search warrants for paint, note that this is a vinyl sided home, loose gutter and broken windows?

I spoke to Ed today and was told that College avenue was one of the areas that the stepped up enforcement was being enforced on.  I did not get a clear cut answer as to anything I ask - not that I expected to - he did tell me that residents could file an appeal - we know that - but I still did not get an answer as to how access was gained into the property - even with the search warrant - they still had to get through the door - nobody can answer that darn question?  I also ask how a search warrant was granted on such flimsy evidence - based on the sworn affidavit that every effort was made to contact Des. - and since she not only lived in the finished house, but had a business right up the street, was in and out of the property several times a day, this was not quite accurate - he said that according to inspector Larkins' experience, she must have made the effort.  The only thing they are doing is feed us bull s..it by the bucket.  And what's worse they expect us to swallow it - and like it at that.

This same shameful misuse of federal funds has been rampantly exploited along commercial intersections in Brooklyn Centre, Wards 14 and 15....and no doubt all over the "forgotten triangle" on the east side of Cleveland. If the FBI would just look at little harder at the demolitions taking place and the accounting of those federal funds that cycle through the City of Cleveland. And, what ever happened to lawsuit the City of Cleveland filed against the banks? How about just seizing those properties from the banks right now? I know some families that could use a home. How about the one on my street??

Has Frank been properly diagnosed with any real mental illness? Is he prescribed any medications for his mental condition?

If Frank lived in an old Cleveland house for a long time, he was probably lead poisoned... Cleveland has lead poisoned most of us who have lived here for a while, and it is safe to say Tremont has double-dose lead exposure from the combination of lead in homes and yards (and everything you own) from lead paint dust and lead spewed upon your urban core neighborhood by freeway traffic (decades of leaded gas pollution) and industry (your "Great View", duh).

Perhaps Frank is just lead poisoned, like you and me, but more so. That will cause all sorts of mental problems for Frank, and perhaps a few for society. Our usual solution for lead poisoned adults is to put them in prison. Sound familiar?

My dad is a nationally respected psychiatrist, who has done court testimony, and he could evaluate Frank's condition. He also knows all the shrinks in town so could steer us toward other professionals for help. I am also good friends with Dr. Peter Whitehouse, who I am sure would offer support for a consultation.

Don't allow just anyone to diagnose Frank's "Mental" problems. Looking at Frank's past, assume significant lead poisoning, and ask yourself if you may be next to be victimazed for living in the wrong places, at the wrong times, under the wrong leadership.

What is also so very important is in the Affidavit sworn to by Inspector Larkins was that she made every effort to contact the owner of the property Des owns - when we all know that that could not have been so - since everyone in the neighborhood knows that Des lives on the premises - in the beautifully finished house - has a business just up the street - and is in and out of the property several times a day.  How about a note on the door or in the mail box?  Next question - What is a Judge doing signing a Search Warrant on such flimsy evidence.  Based on no more evidence than that, he could have been signing a Search Warrant for one of these $400K properties.  And if on some off chance, the inspector got inside, where are the pictures.  Why do they have her newly rehabed house down as the demo property - they say the city doesn't make mistakes. 

Which Judge, which court? Prepare for Obama and change!

You should start scanning and posting all the legal documents of this case - pretty soon a lawyer will smell big money and jump to Frank's defense.

As soon as you say judge, you say politics... and NEO politics will make Illinois look like pre-school, when Obama gets in office and starts dismantling the evil corruption the 0.1% put in place to amassed their perverse wealth. It will take a few months for him to shake up the FBI and CIA and then they will swoop in...for real.

Judge Pianka signed the search warrant nailed to Des' property - based on the sworn Affidavit provided by Inspector Larkins who by the way was brought in to replace Jose Ramos in the Tremont area because in Ron O'Leary's words he wasn't giving out enough citations - and at a housing committee meeting on November 6, 2008, John Moss promised Ron O'Leary credit for his part in the "good cop bad cop" plot.  What kind of credit was he talking about?  Our good Councilman Cimperman was also present at the rather heated gathering as well.  Now we find out that Moss and O'Leary have been having these little clandestine "sub-committee" project meetings that is not scheduled for the "membership" of TWDC.  Rumor has it floating around that some of the Judge's campaign funds came from Duck Island.

From what I hear, there are many search warrants being executed for very minor repairs.  I will post additional info once the request for public records regarding search warrants from housing court is delivered.  I will let everyone know once the request is fulfilled.  Search warrants are for very serious issues that could affect the public's health and safety, fire hazards, etc.  NOT for minor repairs such as peeling paint, gutters, etc.  Many home owner's rights are being violated.  This needs to stop with Frank Giglio.

Luckily, some of the more financially fortunate home owners are fighting this.  What if you are poor and can not afford shoes, let alone an attorney.

Any reference to lead paint?

The main health and safety issue with unkept Cleveland-area property is lead paint. Lead paint dust and chips must be addressed - they will premanently poison everything they touch and it is worth inspecting for this property defect and fixing it, to protect public health.

Considering that there are 100,000s of residential units in the Cleveland area with lead paint, poisoning 1,000s of children each year, this is the highest priority of every housing related person you have listed here.

As a co-chair of the Greater Cleveland Lead Advisory Council - GCLAC - I am concerned that our elected officials do not take lead poisoning seriously enough - I've made a point of asking Councilman Cimperman to join the Infrastructure and Sustainability subcommittee of GCLAC and, while I don't think he has personally attended, he has sent a representative.

We do not have enough resources to deal with lead poisoning issues in our housing stock, yet we are using public-housing related public funding and resources for these Cleveland Foundation Neighborhood Progress neighborhood clear-cuttings... Strategic Investment Initiative Zones - and they seem to be causing more harm than good. Yjis is all the fault of the Foundation - you are a victim of poor planning and heartless community leadership... and they sincerely think they are doing the right thing by bulldozing your houses and transferring your property to people they think will be better for theri model communities.

So our housing related resources are being used for the wrong things, reducing resources available for the right things.

So are any of the housing related enforcement actions in Tremont related to lead paint, specifically?

I find it really hard to believe that someone called this number and "didn't get an answer or a machine."

This is a place of business and even if I'm not here, I have people who work for me. Every phone call is a potential business transaction. My folks understand that well. If they are with a customer, they look at the callerid and call the number back. And we have an answering machine.

Transparency

a.) Frequent property transfers 

b.) Demolition contractors paid with public funds/liens selectively applied

c.) Parties camoflauged under LLCs/inequitable tax assessment

If such FLAGS occur--as witnessed in Tremont and, less apparently, throughout NEO, especially in Cleveland...don't our elected officials and county prosecutor and local media owe it to the public, to make the process transparent?  Under a democracy, is it the taxpayers' job to police the police?

There is a weak chorus that would claim that these flags truly signal  POSITIVE development on behalf of the public and a greater good as government addressing health and safety concerns. 

SHOW US who benefits and provide the justification for these governmental actions and then explain HOW this is not racketeering as described under RICO statutes.

There has been no transparency here.

 

Foundation role... in all aspects of unreal NEO life

Didn't you notice the Cleveland Foundation just took their corporate-charity BOD/GCP and the public-funded TeamNEO Christmas shopping in Europe. Frank called and chatted with Dan Moulthrop each morning, making the whole process as transparent as the Cleveland Foundation's IdeaStream...

A very few strong Foundation forces here fund and justify the secrecy... after all, they are The Fund For Our Economic Future... and they say, "oh, you poor city we stripped of tax base, you can't afford consultants... you can't afford lawyers... you can't afford transition teams... you can't afford public forums... you can't afford public relations...you can't afford free elections... let us help!"

They give a few $1 million and some tickets to Europe (is that legal), and fund new taxes to pay themselves back. They make "us" hire a bunch of McKinsey consultants and Fred Nance and Squire Sanders, over and over... they conclude, "we'll take all your public funds and spend it smarter, for you... we're Your Foundation!... trust us."

Live with it, or do something about it. Changing all that starts with challenging your public officials to pledge allegiance to the public.

One of m subcontractors/fashion partners was upset by all of this housing stuff and she took it upon herself to write to Cimperman and the Mayor's Action Line directly.   Nita has chosen Cleveland after spending a great deal of time and career success in New Orleans (she moved here before Katrina.)  Her letter is so beautifully stated and captures much of the attitude and energy I read on this site, that I thought it was worth re-posting:

Dear Councilman Cimperman, Mayor Jackson, and others it may concern,

I am very concerned about the demolitions slated for several
residences in Tremont, particularly the one located at 716-14 College.
I lived in Tremont off and on for many years and have been employed in
the neighborhood. As a resident in the 1980s, I saw vast improvements
in the quality of residence, not to mention the quality of life. When
I returned to Cleveland in 2003 and visited Tremont I was agape at how
the neighborhood had been transformed into a place that was ideal for
professionals and families to live, and for small businesses to
thrive. This neighborhood was saved in large part thanks to the
relentless efforts of its residents and other concerned parties who
possessed considerable vision, savvy and drive.

While the construction of a few condominiums seemed like an okay idea
on the surface - "progress" comes in many forms, after all - in the
last couple of years I've found that these new constructions have been
engulfing this historic neighborhood, robbing it of its charm. These
new homes are quite costly and the necessary demolitons that made way
for these homes has caused many longtime residents to move from the
area - and out of the City of Cleveland's tax base. I've also noticed
that many of these new constructions lay vacant, thanks in large part
to the national and local economy.

Though I no longer live in Tremont (I live in Mike Polensek's Ward
11), I still love visiting Tremont on at least a weekly basis. I am
close with many of the residents and patronize the businesses. These
slated demolitions are just wrong. Why are you demolishing these
homes, especially ones that are owner-occupied?

Desiree Schmitt, the owner of 716-14 College, is a long-time Tremont
resident. She also owns a business in that neighborhood, Southside
Concierge & Cleaners. When the powers that be go after residents like
her, you are destroying the very people that helped make Tremont what
it is today. PLEASE DO NOT DESTROY THIS PROPERTY OR OTHERS LIKE IT!

I am a resident of Cleveland, a registered voter, and an honors
student at Cleveland State University who is graduating this May. It
is actions like these that make Cleveland a less than hospitable place
to live, and I have less confidence in its future than ever before.

As a frequent Tremont visitor but not insider, I never had any idea all this was happening under the surface there. I'm glad all this is coming forward as it makes me more committed than ever to the businesses and people I love there - and we are certainly spreading the word.
