entertainment environment that will fill a body bag per week, I am sick and tired of council persons running their own fiefdoms, 1,000 pages of bullshit to look over,  city wide petition against the planning commission

Just for everyone's info, there is talk in the Tremont C,ommunity (OSSCC) members and other residents of putting out a city wide petition against the planning commission, Mr. Brown and the Councilman if this meeting goes forward tomorrow without the amendments being sent out. As far as the meeting being stacked, there's no suprise there.  We've been dealing with the ordinary citizens in our community being cut out of the loop for years now.  Anyone whose ever attended a block club or TWDC meeting where power players want something supported - gets stacked to the hilt.
 
I am going to contact Art McCoy and other eastside activists who I met at Channel 19, and get them to storm City Council Committees, because this legislation is discriminatory and as I told others in the past we are creating an entertainment environment that will fill a body bag per week, and those are going to be filled on the eastside of Cleveland predominantly.
 
The media will again cover tomorrow's hearing and we will see who is pulling Director Brown's puppet strings.
 
I think after tomorrow we will see who is on our side, and who is talking out of both sides of their political agenda.

I think after tomorrow we will see who is on our side, and who is talking out of both sides of their political agenda.
 
I can also tell you one or two people have changed their position that spoke on April 1st. So look for no amendments, look for a room of nightclub operators, and backroom deals that benefits downtown residents.
 
 I am sick and tired of council persons running their own fiefdoms.
 
The media will again cover tomorrow's hearing and we will see who is pulling Director Brown's puppet strings.
 
I think if no amendments are passed we should boycott any downtown restaurants and clubs. it was already brought to my attention residents will start picketing the Harp.

Last week after talking to someone at city hall, I posted an email saying that this legislation was going to be passed without much community input and with little transparency.
You responded to my post and overwhelming denied there was any effort to exclude residents and reassured me that the process was transparent. 
I took you at your word and after leaving the meeting on the 4/1/11, I thought perhaps you were correct.
But right now….I’ m beginning beginning to wonder.
Can you tell me do you support the current proposed legislation, (without amendments) being passed by the planning commission tomorrow.
If you do support it can you explain why?
If you don’t  support it will urge the vote to be postponed?

I want to re-state that the City Planning Commission and the City are taking the issues related to entertainment-related uses and their impacts on residents very seriously.  That is why we have spent months developing and refining proposed zoning and licensing regulations and will continue to do so, in consultation with the community.  And that is why we are reaching out to groups in neighborhoods all across the city.  We will continue that process at the Planning Commission meeting tomorrow morning and then at further community meetings and Council Committee meetings.  Our goal in this matter has been and will always be to serve the good of the residents of Cleveland.

I am going to send one last email today, then it will be my last communication on the Subject. I will be attending the Planning Commission tomorrow morning and advocating on behalf of all of you that attended the April 1st meeting,  I would suggest you all contact Councilman Joe Cimperman and Director Robert Brown. I have spoken with some new stakeholders in the downtown area who are being encouraged to attend  tomorrow by downtown CDC's. They are being told that changes will be made after the fact and this is really not important and we are six months away. Then why did the Planning Commission table the matter? Just to look good for the press and a standing room only crowd? This again is politics 101 in the City of Cleveland.  We all know who written this legislation and why they want outdoor entertainment and speakers. You will see in the copied email here below Councilman Cimperman's downtown CDC's are advocating for extended hours for outdoor sound on patio's. So to wit they are advocating for outdoor speakers.
 
I am not going to attend any other Council Committee hearings because most are condescending dog and pony shows and the chairpersons have the right not to recognize you. Have you ever spoken or try to speak at a city council meeting, no you will taken away. The Planning Commission is a public hearing, the Council Committees are public meetings. I sat at a Council Hearing for five hours last year and had at least three councilpersons request dialog on Streetlights to still have me completely ignored by the Committee Chairperson.
 
I apologize, I like to fall on my sword a lot for the will of the people. But it is less that 24 hours from the Planning Committee and clearly we have not seen any amendments. Some of you forwarded me short responses by the City Administration.
 
I will report the outcome of tomorrows Planning Commission, who knows I may need bail money.
 
I most certainly hope when this is all complete we can have a right to privacy. We as residents in neighborhoods should be insulted that the interests of a entertainment district in downtown will motivate this decision. Frankly I had more respect for the owners of La Copa compensating drunks to come to the public meeting for zoning support.
 
We can start organizing play parties, I believe we can audiotape the sound of illegal noise from your favorite patio I recommend the Barley House I understand residents down in the warehouse district cannot sleep.  and then play in through a loudspeaker in front of the Mayor's House, Ken Silliman's, Director Brown's, Councilperson's homes, and whoever else wants to punt the ball tomorrow morning.

Dear Downtown Stakeholder:
On Friday, April 15th at 9 a.m. in Room 514 City Hall, the City Planning Commission will have its second discussion on proposed zoning and licensing regulations that apply to nightclubs, restaurants/bars with entertainment, and related uses. 
Attached is proposed legislation related to zoning and licensing of entertainment venues.  I also included a simpler version with some explanation.  This legislation will update and replace current ordinances that relate to entertainment venues including restaurants, night clubs, live music venues and bars.
There is some discussion among downtown stakeholders that noise limitations be amended for the downtown to be later than the proposed 10:00 pm.  Both Historic Warehouse District Development Corporation and Downtown Cleveland Alliance passed are advocating for the time to be extended for sound on outdoor cafes.
I understand that there is a lot of legal ease in the document, but we wanted to be sure that everyone has a chance to review and provide comment.  Councilman Joe Cimperman wants the approval of this legislation to be open and transparent.
There will be public meetings scheduled in the near future to discuss the legislation.

I am on the agenda of the Second District Community Relations Committee tonight, and I am proceeding under the premise that we do not know if the Administration will amend the legislation as it was presented at the Planning Commission. I am planning on attending this Friday's Planning Commission, I would ask everyone who attended the Friday April 1st meeting to also attend if you have availability. I would not ask folks to take another day off work.
 
If there are no amendments presented with the intent to pass the ball down the field I will testify that this needs to be tabled again. The usual process here needs to take a back seat and shear ethics needs to prevail.

Henry, thank you for sharing this information with others.  The reason for identifying key issues and various options for further amendments in the most recent draft is to allow for more public comment in preparation for the April 15th City Planning Commission session.  We will continue listening carefully and being responsive to the comments we receive. 
 
After the Planning Commission meeting, the public dialog will continue at community meetings being scheduled by City Council and at meetings of the City Council Committees.  There is no doubt that the final ordinance will be better and more effective as a result of this dialog.

I will try to be very brief. I am forwarding an email from City Planning Director Robert Brown. He has given his permission to forward the email in its text.
 
Councilman Cimperman called a meeting with his staff, Director Brown, Commissioner Stephens from Licence & Assessments, Linda Barley, and myself Tuesday afternoon. This meeting was a brief meeting, it was my understanding based on the discussion we would discuss the top three points of contention that needed amendments prior to the legislation was to be re-introduced at the April 15th Planning Commission.
 
It was clear based on the testimony and letters received at City Planning the top issues are.
 
1) Musical performances and sound devices on outdoor dining patios.
 
2) Lowering the parking requirements for outdoor dining patios.
 
3) Increasing bi-annual fees for nightclubs and entertainment venues permitted under conditional use permits.
 
 
The document attached has notes by these three points within the text, and gives multiple options for future discussions.  It was the impression of Councilman Cimperman, Linda Barley, and I that the actual amendments would be put into the text as discussed at the April 5th meeting.
 
I do realize we have a week for City Planning staff to do this, Director Brown pointed out he was out of town to next Wednesday and there still is opportunity for the amendments to take place.
 
What was the consensus of the meeting on April 5th.
 
1) An additional CUP would be required for any musical performances or sound devices on outdoor dining patios, including hours of operation within the CUP. (343.15).
 
2) The current proposal changing the parking requirements for outdoor dining patios would be removed and the law would remain the same as it is now. One space for every four seats. (349.04)
 
3) The bi-annual fees for nightclubs and entertainment venues permitted under conditional use permits would be incrementally increased to pay for nighttime inspectors of these establishments. The bigger the space would require several mandatory team inspections per year. Versus smaller sites may need only one. This to insure all CUP, Licensing,Safety, and Health requirements are satisfied.
 
It was agreed upon that if these main issues were amended Linda Barley and I would appear at the April 15th Planning Commission and testify that the main concerns pointed out at the April 1st Planning Commission have been addressed and other small changes could be changed down the road in other City Council Committees. We would recommend passage with the amendments stated but now we do not know if we have a commitment from the City Administration to do so.
 
But with that said, to this date all we have are recommendations listed on the last pages of the attached document in this forwarded email and no amendments. I recommend that everyone contact via email Director Brown, Councilman Cimperman and Councilman Cleveland, and the members of the Planning Commission. Their emails are in the CC of this email, and state unless these three non-negotiable issues are not included as amendments on Friday morning April 15th at the Planning Commission that you recommend further tabling of the legislation until this matter is resolved.
 
It was plainly understood this is what the Planning Commission members requested by tabling this matter. I do not believe it was their intent to ask for options.

entertainment environment that will fill a body bag per week, I am sick and tired of council persons running their own fiefdoms, 1,000 pages of bullshit to look over,  city wide petition against the planning commission

Just for everyone's info, there is talk in the Tremont C,ommunity (OSSCC) members and other residents of putting out a city wide petition against the planning commission, Mr. Brown and the Councilman if this meeting goes forward tomorrow without the amendments being sent out. As far as the meeting being stacked, there's no suprise there.  We've been dealing with the ordinary citizens in our community being cut out of the loop for years now.  Anyone whose ever attended a block club or TWDC meeting where power players want something supported - gets stacked to the hilt.
 
I am going to contact Art McCoy and other eastside activists who I met at Channel 19, and get them to storm City Council Committees, because this legislation is discriminatory and as I told others in the past we are creating an entertainment environment that will fill a body bag per week, and those are going to be filled on the eastside of Cleveland predominantly.
 
The media will again cover tomorrow's hearing and we will see who is pulling Director Brown's puppet strings.
 
I think after tomorrow we will see who is on our side, and who is talking out of both sides of their political agenda.

Hello Rebecca, All:
 
I think after tomorrow we will see who is on our side, and who is talking out of both sides of their political agenda.
 
I can also tell you one or two people have changed their position that spoke on April 1st. So look for no amendments, look for a room of nightclub operators, and backroom deals that benefits downtown residents.
 
 I am sick and tired of council persons running their own fiefdoms.
 
The media will again cover tomorrow's hearing and we will see who is pulling Director Brown's puppet strings.
 
I think if no amendments are passed we should boycott any downtown restaurants and clubs. it was already brought to my attention residents will start picketing the Harp.
 
I am going to contact Art McCoy and other eastside activists who I met at Channel 19, and get them to storm City Council Committees, because this legislation is discriminatory and as I told others in the past we are creating an entertainment environment that will fill a body bag per week, and those are going to be filled on the eastside of Cleveland predominantly.
 
My opinions are solely my own and I am not speaking as a board member of TWDC.

Last week after talking to someone at city hall, I posted an email saying that this legislation was going to be passed without much community input and with little transparency.
You responded to my post and overwhelming denied there was any effort to exclude residents and reassured me that the process was transparent. 
I took you at your word and after leaving the meeting on the 4/1/11, I thought perhaps you were correct.
But right now….I’ m beginning beginning to wonder.
Can you tell me do you support the current proposed legislation, (without amendments) being passed by the planning commission tomorrow.
If you do support it can you explain why?
If you don’t  support it will urge the vote to be postponed?

I want to re-state that the City Planning Commission and the City are taking the issues related to entertainment-related uses and their impacts on residents very seriously.  That is why we have spent months developing and refining proposed zoning and licensing regulations and will continue to do so, in consultation with the community.  And that is why we are reaching out to groups in neighborhoods all across the city.  We will continue that process at the Planning Commission meeting tomorrow morning and then at further community meetings and Council Committee meetings.  Our goal in this matter has been and will always be to serve the good of the residents of Cleveland.

Good Morning All:
 
I am going to send one last email today, then it will be my last communication on the Subject. I will be attending the Planning Commission tomorrow morning and advocating on behalf of all of you that attended the April 1st meeting,  I would suggest you all contact Councilman Joe Cimperman and Director Robert Brown. I have spoken with some new stakeholders in the downtown area who are being encouraged to attend  tomorrow by downtown CDC's. They are being told that changes will be made after the fact and this is really not important and we are six months away. Then why did the Planning Commission table the matter? Just to look good for the press and a standing room only crowd? This again is politics 101 in the City of Cleveland.  We all know who written this legislation and why they want outdoor entertainment and speakers. You will see in the copied email here below Councilman Cimperman's downtown CDC's are advocating for extended hours for outdoor sound on patio's. So to wit they are advocating for outdoor speakers.
 
I am not going to attend any other Council Committee hearings because most are condescending dog and pony shows and the chairpersons have the right not to recognize you. Have you ever spoken or try to speak at a city council meeting, no you will taken away. The Planning Commission is a public hearing, the Council Committees are public meetings. I sat at a Council Hearing for five hours last year and had at least three councilpersons request dialog on Streetlights to still have me completely ignored by the Committee Chairperson.
 
I apologize, I like to fall on my sword a lot for the will of the people. But it is less that 24 hours from the Planning Committee and clearly we have not seen any amendments. Some of you forwarded me short responses by the City Administration.
 
I will report the outcome of tomorrows Planning Commission, who knows I may need bail money.
 
I most certainly hope when this is all complete we can have a right to privacy. We as residents in neighborhoods should be insulted that the interests of a entertainment district in downtown will motivate this decision. Frankly I had more respect for the owners of La Copa compensating drunks to come to the public meeting for zoning support.
 
We can start organizing play parties, I believe we can audiotape the sound of illegal noise from your favorite patio I recommend the Barley House I understand residents down in the warehouse district cannot sleep.  and then play in through a loudspeaker in front of the Mayor's House, Ken Silliman's, Director Brown's, Councilperson's homes, and whoever else wants to punt the ball tomorrow morning.

Dear Downtown Stakeholder:
On Friday, April 15th at 9 a.m. in Room 514 City Hall, the City Planning Commission will have its second discussion on proposed zoning and licensing regulations that apply to nightclubs, restaurants/bars with entertainment, and related uses. 
Attached is proposed legislation related to zoning and licensing of entertainment venues.  I also included a simpler version with some explanation.  This legislation will update and replace current ordinances that relate to entertainment venues including restaurants, night clubs, live music venues and bars.
There is some discussion among downtown stakeholders that noise limitations be amended for the downtown to be later than the proposed 10:00 pm.  Both Historic Warehouse District Development Corporation and Downtown Cleveland Alliance passed are advocating for the time to be extended for sound on outdoor cafes.
I understand that there is a lot of legal ease in the document, but we wanted to be sure that everyone has a chance to review and provide comment.  Councilman Joe Cimperman wants the approval of this legislation to be open and transparent.
There will be public meetings scheduled in the near future to discuss the legislation.

I have been receiving a few phone calls, and frankly several people are somewhat confused. I am on the agenda of the Second District Community Relations Committee tonight, and I am proceeding under the premise that we do not know if the Administration will amend the legislation as it was presented at the Planning Commission. Let not forget the Planning Commission tabled supporting the legislation with the expectation amendments would address the top concerns voiced on Friday April 1st.
 
Councilman Cimperman called a meeting on April 5th, and it was Councilman Cimperman's, Linda Barley, and I's understanding we would see amendments not talking points.
 
Will wee see written amendments prior to this Friday's Planning Commission? Yes? No?
 
Since it is very hard to read into the legislative crystal ball, as I said in an Email this past Friday it would be best for all the respondents in this email thread to start responding and reminding the Planning Commission exactly why the legislation was tabled. Please reply all and respond to the City Officials in this email thread.
 
I am planning on attending this Friday's Planning Commission, I would ask everyone who attended the Friday April 1st meeting to also attend if you have availability. I would not ask folks to take another day off work.
 
If there are no amendments presented with the intent to pass the ball down the field I will testify that this needs to be tabled again. The usual process here needs to take a back seat and shear ethics needs to prevail.

Henry, thank you for sharing this information with others.  The reason for identifying key issues and various options for further amendments in the most recent draft is to allow for more public comment in preparation for the April 15th City Planning Commission session.  We will continue listening carefully and being responsive to the comments we receive. 
 
After the Planning Commission meeting, the public dialog will continue at community meetings being scheduled by City Council and at meetings of the City Council Committees.  There is no doubt that the final ordinance will be better and more effective as a result of this dialog.

I will try to be very brief. I am forwarding an email from City Planning Director Robert Brown. He has given his permission to forward the email in its text.
 
Councilman Cimperman called a meeting with his staff, Director Brown, Commissioner Stephens from Licence & Assessments, Linda Barley, and myself Tuesday afternoon. This meeting was a brief meeting, it was my understanding based on the discussion we would discuss the top three points of contention that needed amendments prior to the legislation was to be re-introduced at the April 15th Planning Commission.
 
It was clear based on the testimony and letters received at City Planning the top issues are.
 
1) Musical performances and sound devices on outdoor dining patios.
 
2) Lowering the parking requirements for outdoor dining patios.
 
3) Increasing bi-annual fees for nightclubs and entertainment venues permitted under conditional use permits.
 
 
The document attached has notes by these three points within the text, and gives multiple options for future discussions.  It was the impression of Councilman Cimperman, Linda Barley, and I that the actual amendments would be put into the text as discussed at the April 5th meeting.
 
I do realize we have a week for City Planning staff to do this, Director Brown pointed out he was out of town to next Wednesday and there still is opportunity for the amendments to take place.
 
What was the consensus of the meeting on April 5th.
 
1) An additional CUP would be required for any musical performances or sound devices on outdoor dining patios, including hours of operation within the CUP. (343.15).
 
2) The current proposal changing the parking requirements for outdoor dining patios would be removed and the law would remain the same as it is now. One space for every four seats. (349.04)
 
3) The bi-annual fees for nightclubs and entertainment venues permitted under conditional use permits would be incrementally increased to pay for nighttime inspectors of these establishments. The bigger the space would require several mandatory team inspections per year. Versus smaller sites may need only one. This to insure all CUP, Licensing,Safety, and Health requirements are satisfied.
 
It was agreed upon that if these main issues were amended Linda Barley and I would appear at the April 15th Planning Commission and testify that the main concerns pointed out at the April 1st Planning Commission have been addressed and other small changes could be changed down the road in other City Council Committees. We would recommend passage with the amendments stated but now we do not know if we have a commitment from the City Administration to do so.
 
But with that said, to this date all we have are recommendations listed on the last pages of the attached document in this forwarded email and no amendments. I recommend that everyone contact via email Director Brown, Councilman Cimperman and Councilman Cleveland, and the members of the Planning Commission. Their emails are in the CC of this email, and state unless these three non-negotiable issues are not included as amendments on Friday morning April 15th at the Planning Commission that you recommend further tabling of the legislation until this matter is resolved.
 
It was plainly understood this is what the Planning Commission members requested by tabling this matter. I do not believe it was their intent to ask for options.
 
I will let everyone know of any further developments, and again thank you for all your efforts to date. Please feel free to send this email to others.

If Cimperman's ($)hit list keeps growing, we'll soon have enough people to start a revolution.

My name has headed up this list for quite a while.  I have no doubt that if someone got a closer look, OCNW Safety Coordinator Robert Shores' name is now penned in. 

What method will the good Councilman use to take Henry out?  I get the feeling it won't be long.  I hear he's (Cimperman) is already out in the flats stringing up some new puppets to play with.

 

Let's encourage Henry Senyak to run against Cimperman

I'll bet Kucinich would help fund Mr. Senyak in a ballot against Mr. Cimperman.  Mr. Senyak won't get much money from the downtown real estate owners, but he will get the votes from the real people in Tremont.

Well, Jerleen, you and Henry, along with Bob, are on a crowded list as Cimperman has cut a wide swath. None of you deserve it.

I saw as you did your best to work with the councilman, and you gave him many chances to redeem himself.

All that was being asked was that the democratic process be followed. The process is hard work, and it means including all people, and not all people are going to buy the party line. It is too easy to exclude those people.

Thank you all for what you have done, and will continue to do.
